Issues arising from a TUPE transfer
TUPE is the well known abbreviation for the transfer of undertakings (protection of employment) regulations. The latest addition was issued in 2006.
Their applicability and the burden they impose are relevant in any business transfer where staff are to be retained and, indeed, when they are not.
The principal purpose of the regulation is to avoid staff being prejudiced by a transfer of a business. This is to prevent a new owner introducing or imposing less favourable terms and conditions.
It is impossible to give a further detailed explanation in a short note, but we will be able to offer bespoke advice upon this area, the consequences for any that are involved and to offer practical advice that will seek to mitigate against any issues that arise from the application of the regulations.
