Changes in Disciplinary and Grievance Procedures 04/03/2009

On the 6 April 2009, the current statutory framework for dealing with Disciplinary, Dismissal and Grievance Procedures will be repealed. As an Employer therefore, you will no longer have to comply with the current procedures in place.
You will, however, be expected to deal with any Disciplinary and Grievance issues in a fair and reasonable manner in compliance with the revised ACAS Code of Practice on Disciplinary and Grievance Procedures which provides practical guidance on how to deal with related issues as well as setting the standard for reasonable behaviour.

A failure to comply with the Code of Practice will not automatically result in a ruling against you. However, it is important to keep in mind that the Employment Tribunal is obliged to take the Code of Practice into consideration when making a decision as they have the power to increase compensation by as much as 25% if it finds that you have acted in an unfair and unreasonable manner.

To prevent being caught out by these changes, it is important to have your current Disciplinary and Grievance procedures reviewed and updated.
