This obviously arises in many different contexts and may well be straightforward and consensual. However, others may be enforced or be ambiguous. It is always worth bearing in mind that the Courts and Tribunals will expect the employer to be clear about what is going on and to get all the policies, notices and payments correct. It is for the employer to make sure that no-one, least of all the employee, is in any doubt about what has happened and why. Employers make themselves an easy target if they do not take the lead.

In difficult situations, it may be appropriate to ensure certainty by entering into a formal termination agreement in which you can ensure that you have achieved certainty in return for perhaps an agreed severance package.
